CEISTEANNA—QUESTIONS. [ ORAL ANSWERS. ] - THE EXTRADITION ACT.

asked the Minister for Home Affairs whether the Extradition Act, 1870, is one of the laws continuing to be in full force and effect in Saorstát Eireann as laid down in Article 73 of the Constitution; if so, whether there exists any convention or treaty or Order in Council or other arrangement covering the extradition of fugitive French citizens found in Ireland, and of fugitive citizens of Saorstát Eireann found in France; whether in the case of a request being made by the Saorstát for the extradition of a Saorstát citizen from France there is any French statute corresponding to the Extradition Act, 1870, which would prevent the surrender by France of a Saorstát citizen wanted for a political offence; and further, whether there is any statute now in force in Saorstát Eireann which would allow the surrender by the Saorstát of a foreign citizen being fugitive in Ireland for political offences committed within his own State?

I am advised that the Extradition Acts 1870-1906 do not apply to Saorstát Eireann unless and until an Act of the Oireachtas makes those Acts applicable. The rest of the question does not arise.
