CEISTEANNA—QUESTIONS. ORAL ANSWERS. - ENNISTYMON BOMB EXPLOSION.

asked the Minister for Finance if he is aware of the amount of the award made in respect of Daniel Fitzpatrick, Ennistymon, who was injured by bomb explosions in that town during its occupation by British forces, and if he will state on what basis that award was calculated, and if any appeal can be made against that award and, if so, if he will state to what tribunal.

The person named by the Deputy was awarded a decree for £226 5s. and £18 18s. 3d. costs, by the County Court Judge of the County of Clare, in April, 1922. An appeal was lodged against this decree by the Clare County Council. The British Government accepted liability for payment of compensation in this case as a breach of the Truce on the British side, and as the appeal against the decree was still pending, the case was submitted for assessment of compensation to Messrs. Dowdall and Howell Thomas, of the Compensation (Ireland) Commission, who heard the case and awarded £250 compensation, and £23 12s. 9d. costs. This award has been paid by the British Government. I am satisfied that Messrs. Dowdall and Howell Thomas took all the facts of the case into consideration, and I see no reason why representations should be made to the British Government with a view to the case being reconsidered.

Will the Minister answer the second part of the question—that is, if any appeal lies from the award, and, if so, to what tribunal?
