CEISTEANNA—QUESTIONS. ORAL ANSWERS. - PRE-TRUCE OFFICER'S PENSION CLAIM.

asked the Minister for Defence if he received from William Considine, Clahane, Liscannor, Co. Clare, an application for a pension in respect of his disability contracted during the Anglo-Irish war whilst he served as an officer in an Active Service Unit, and whether he can now consider sympathetically the application.

The disability contracted by Mr. Considine was not due to a specific wound or injury received in the course of duty whilst on active service. His case does not therefore come within the provisions of the Army Pensions Act, 1923. Mr. Considine states that he suffered a breakdown of health. The amendment of the Act to cover cases of severe or permanent illness arising out of active service is, however, under consideration. Pending the necessary legislation, I regret that I have no power to entertain Mr. Considine's application, and Mr. Considine was informed accordingly on the 17th April and the 7th ultimo.

Will such cases be reviewed under the new legislation?

It will depend upon whether the new legislation covers that particular type of case.
