Vol. 8 No. 12

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CLONEE MAN'S ARREST.

asked the Minister for Defence if he will state whether compensation has been awarded to Patrick Moore, of Portmanna, Clonee, who was arrested by National Forces and detained in Trim Barracks for six weeks from 24th October, 1922, to 4th December, 1922, without any charge being preferred against him, and in relation to which detention he was put to very considerable legal costs, and, if not, why not.

Mr. Moore was arrested on the 24th October, 1922, on a charge of the military offence of being in possession of a gun and ammunition without proper authority. On the 20th November, 1922, he applied in the King's Bench Division for a writ of habeas corpus. His application was refused. He appealed against this decision. The Court of Appeal dismissed his appeal with costs, to be paid by himself. In the circumstances a claim for compensation cannot be entertained.
