RULES OF CRIMINAL APPEAL COURT—MINISTER'S CORRECTION

Either now or at the adjournment I would like to make a short statement by way of explanation and correction of inaccurate information which I gave to the Dáil at its last sitting.

I think it would be better to have the statement now.

It is in connection with the Rules of the Criminal Appeal Court, which the Dáil sanctioned on the occasion of its last meeting. Deputies will remember that on that day there was placed in their hands a printed copy of the Rules and a typed sheet, containing for the most part, certain corrections, and one new Rule —Rule 44. In the course of the discussion, Deputy Johnson asked for an assurance that these corrections had been before the Seanad, including the new Rule. I replied that my information was that both had been before the Seanad. The corrections, in fact, were before the Seanad, written in ink on the proof that was supplied to Senators. I have not been able to get as definite an assurance as I would wish that Rule 44 was brought specifically before the notice of Senators and I take this, the earliest opportunity, to modify and qualify to that extent what I said. I also think that, in view of the fact that there is some doubt as to whether this Rule was brought to the notice of Senators or not, we should consider that Rule as inoperative pending consideration of the complete set of Rules which will take place when the Dáil meets in October.
