Vol. 9 No. 15

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - REMISSION OF FINE.

asked the Minister for Justice if he can state the reasons why his Department refused to remit the redemption fine of £6 paid by Mrs. Bridget Curley, of Cloonascragh, Ballinasloe, on account of cattle seized by military from the lands of Mr. Howard, or how the trespass in her case can be held to be not accidental, seeing that all the stock seized on this occasion had been jointly grazed on a farm adjoining Mr. Howard's, and that the owners other than Mrs. Curley have had their redemption fines remitted.

Under the provisions of the Public Safety (Punishment of Offences) Temporary Act, 1924, there is power to remit fines imposed for the redemption of seized cattle only where the trespass is innocent. The information before me in the case of Mrs. Curley goes to show that the trespass was deliberate. If the Deputy can give some additional facts to prove that the trespass was not wilful, I will cause further inquiries to be made in the matter.
