Vol. 12 No. 5

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - UNPAID AWARD FOR MALICIOUS DAMAGES.

asked the Minister for Finance if he is aware that an award of £618, made by Judge McElligott at Limerick in November, 1924, to Mr. Michael Carroll, Mongfune, Murroe, Limerick, for malicious damages, has not yet been paid, and if he will state what steps are being taken to expedite payment in this case.

This case is one in which it appears that a reinstatement condition should have been attached by the Judge to his award. There is some doubt as to whether such condition was attached; the Decree, as received in my Department, does not contain any condition, and the matter is still the subject of correspondence. I will take all possible steps to expedite a settlement.

What does the Minister mean by "reinstatement condition should have been attached"? Does the Minister wish to dictate to a judge as to what he should or should not do?

No, sir.
