DAIL IN COMMITTEE. - LOCAL AUTHORITIES (COMBINED PURCHASING) BILL, 1925.—FROM THE SEANAD.

I move:—"That the Committee agree with the Seanad in the following amendments":

1. In Section 1, after the word "authorities," line 19, the words "in Saorstát Eireann or any particular part thereof" inserted.

2. In Section 3 (1), the words "in respect of," lines 44-5, deleted, and the words "for the supply of" substituted therefor, and in line 45 after the word "commodities" the words "to local authorities in Saorstát Eireann or any specified part thereof" inserted.

3. In Section 3 (3), after the word "period," line 57, the words "and for the area" inserted.

Question put and agreed to.

I move:—"That the Committee do not agree with the Seanad in amendment 4":

In Section 6 (2), after the word "shall," line 52, the words "if required" inserted.

In the Seanad I pointed out that this was contrary to the whole tenor of the Bill and of the procedure of local government generally, where the onus is thrown on the clerk or secretary of the local authority to point out to the auditor any case where there has been an unusual occurrence. The Bill provides that where a local authority breaks away from the usual procedure, that it should purchase from the central purchasing authority, the clerk or secretary is to bring that fact under the notice of the auditor. If I were to accept this amendment it would mean that the auditor would have to ask the secretary in order to have the matter brought under his notice, in that way changing the onus. Accordingly, I ask the Committee not to agree with the Seanad in the amendment.

I move: "That the Committee agree with the Seanad in the following amendments":—

In Section 12, line 47, before paragraph (d) a new paragraph (d) inserted as follows:—

"(d) authorising the provision by the Minister of official samples of any commodity for which he proposes to appoint an official contractor and providing for the deposit of such official samples for public inspection."

In Section 12, the following new sub-section added at the end of the section:—

"Any regulations made under this Act shall be laid as soon as may be before both Houses of the Oireachtas."

In Section 14, the following words added at the end of the section:

"This Act shall expire after the termination of three years from the date of its passing."
