Vol. 12 No. 9

CEISTEANNA—QUESTIONS ORAL ANSWERS. - DUBLIN COMPENSATION CLAIM.

asked the Minister for Finance if he is aware that a report was made in favour of Mr. Denis Madden, 152 North Strand Road, for £175 by Judge Pigott, at Limerick, in April, 1923, under the Damage to Property (Compensation) Act, 1923; that it is stated that in March, 1925, the State Solicitor called to Mr. Madden's solicitors with an offer of £50 7s. 6d. in settlement of the report, and that Mr. Madden refused the offer, and if he will now state when the Judge's report will be put into operation.

I am satisfied on consideration of all the facts that the amount recommended by the Judge in this case was excessive, and I am not prepared to authorise payment in full. Payment of a reduced amount will be made at an early date.

Will the Minister say whether the claimant in this case has any right of appeal to anybody other than the Minister? Why should the Minister set himself up as the judge of this Judge's action?

I am the Court of Appeal.

Then I am sorry for the people concerned.
