CEISTEANNA—QUESTIONS. ORAL ANSWERS. - ENNIS MERCHANT'S CLAIM.

asked the Minister for Finance if he is aware that his Department has declined to pay on the report granted by the County Court Judge to Mr. Denis Roughan, Abbey Street, Ennis, under the Damage to Property (Compensation) Act, 1923, in respect of goods commandeered from his shop, and if the Minister can state the considerations which determined the decision arrived at, and whether the report claim will be re-opened and further facts admitted as evidence either in support or in rebuttal.

Payment in this case was refused as enquiries showed that the goods were voluntarily supplied by the claimant in the ordinary course of business in expectation of payment. A re-investigation of the case, as a result of representations made on the applicant's behalf, revealed nothing which would warrant a modification of the decision to withhold payment. I am however, prepared to consider any further definite evidence that may be submitted.
