CEISTEANNA—QUESTIONS. ORAL ANSWERS. - CIVIL SERVANTS' TREATY RIGHTS.

asked the Minister for Finance whether the acceptance by an established officer of the late Intermediate Board of a certificated position in the Saorstát Civil Service might be held to alter, vary or cancel any right, including the right of voluntary retirement under Article 10 of the Treaty, enjoyed by the officer at the date of his acceptance, and if the Minister is prepared to state that such acceptance does not interfere with any such right, it being understood that the new position is identical with that held formerly, and that the officer was serving on 1st April, 1922, in an established capacity.

Where the new position in the Saorstát Civil Service is identical with that held under the late Board of Intermediate Education at the date of the transfer of the service from the British Administration the acceptance by a pensionable officer of the late Intermediate Education Board of a certificated position in the Saorstát Civil Service does not, in my opinion, modify any right which the officer may have enjoyed immediately prior to the dissolution of the Intermediate Education Board.
