WORKMEN'S COMPENSATION—MOTION BY MINISTER FOR INDUSTRY AND COMMERCE.

I move:—

Go n-aontuíonn Dáil Eireann le daingniú do dhéanamh i gcóir Shaorstáit Eireann ar an gConvensiún i dtaobh Cúitimh do Lucht Oibre i nGalair Chéirde agus le glaca leis an Mola i dtaobh Cúitimh do Lucht Oibre i nGalair Chéirde le n-ar glacadh an 10adh Meitheamh, 1925, ag an Seachtú Siosón a bhí ag Códháil Idirnáisiúnta an Oibreachais i nGeneva.

That Dáil Eireann approves of the ratification in respect of Saorstát Eireann of the Convention concerning Workmen's Compensation for Occupational Diseases and of the acceptance of the Recommendation concerning Workmen's Compensation for Occupational Diseases adopted on the 10th June, 1925, at the Seventh Session of the International Labour Conference held in Geneva.

This Convention and this recommendation have both been circulated. I want to call attention to the fact, with regard to the Convention, that it provides that compensation shall be payable to workmen incapacitated by certain occupational diseases detailed in the Schedule to the Convention. These diseases are already included in the list of diseases in respect of which compensation is payable under the existing legislation. The Convention therefore can be ratified at once. The same type of remark would apply to the recommendation. The recommendation simply asks that provision should be made for revising the list of diseases classified as occupational in national legislation. That recommendation is covered by Section 8 of the Workmen's Compensation Act of 1906. The recommendation can be accepted without necessitating any change in existing legislation.

I would like to ask why copies of this Convention have not been placed in the hands of Deputies? We are asked to ratify what we have not seen. We have only the Minister's statement.

The Convention has been tabled, and is available in the library, but has not been circulated.

We got no intimation it was tabled.

It was listed on a particular date as tabled, and this motion appeared on the Orders of the Day for several days.

I agree that the resolution should be passed. The Convention makes no change in the law already in force. It is rather a matter of record for the League International Labour Office that we have definitely adhered to the Convention. I would have liked to have had a motion ratifying the Convention on compensation for industrial accidents, which is in advance of the present British law, and also the Convention on equality of treatment for foreign workers and nationals. There is need for a reciprocal arrangement between Great Britain and the Free State, and it would be possible under that Convention for such to be negotiated. I think the House would do well to ratify the present Convention for the purpose of formally recording in the League that we do adhere to this International Convention.
