PUBLIC SAFETY BILL, 1927.—MONEY RESOLUTION. - IN COMMITTEE ON FINANCE.

I move:—

Go bhfuil sé oiriúnach a údarú go n-íocfar amach as airgead a sholáthróidh an tOireachtas, táillí no luach saothair le haon bhall, clárathóir, cléireach no seirbhíseach de Chúirt speisialta, a bunófar fé aon Acht a rithfar sa tSiosón so, chun a thuille socruithe agus chun socrú níos fearr do dhéanamh chun an Stát agus an phuiblíocht do chimeád suas agus do choinneáil o bhaol.

That it is expedient to authorise the payment out of moneys to be provided by the Oireachtas, of fees or remuneration to any member registrar, clerk or servant of a special Court, established under any Act of the present Session to make further and better provision for the maintenance and preservation of the State and the public safety.

The cost is estimated at £2,000 or £2,300.

I have an amendment down to substitute three High Court Judges for the form of special court which is provided in the Bill. As I presume the ordinary officials of the courts would be able to serve the three judges in the manner required, and as I do not think it is necessary to ask for an increase of salary to those judges for this work, which we all hope will be very light and will not have to be done very frequently, I would like to make my position clear on this motion.

Is the Deputy afraid that his amendment would be out of order in Committee after the money resolution had been passed?

No. This provides for a special court not defined. I think the Deputy's amendment, suggesting a tribunal consisting of three members who shall be Judges of the High Court, would be just as much a special court as the one provided in the Bill. Therefore I think his amendment would certainly be in order.

I am glad to know that. I would like to point out that I do not think that if my amendments were carried that it would be necessary to pass this financial motion. Therefore I want it to be understood that though I am not pressing this to a division I am not exactly acquiescing in it.
