PUBLIC BUSINESS. - BODIES CORPORATE (EXECUTORS AND ADMINISTRATORS) BILL, 1928.—SECOND STAGE.

The object of this Bill is to put a corporation into the same position as an individual for the purpose of taking out probate. As the law stands at the moment, a corporation may be appointed an executor or trustee, but there are certain defects from which the corporation suffers. There is no provision in the law as it stands enabling a corporate body either alone or jointly with individuals to take out a grant of probate. The result is that where a corporation is named executor in the will the administration of the will must be granted to the nominee. The whole Bill is aimed at allowing corporations to act either alone or jointly with others. Of course, it is understood that the whole matter is still left practically at the disposal of whoever appoints trustees or executors. There is nothing in this that changes that position.

We do not raise any opposition to this measure.
