Vol. 24 No. 10

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - EMBANKMENT WORK ON KERRY ESTATES.

asked the Minister for Fisheries whether he can state if the embankment work on the Studdert Estate at Ballyoneen, County Kerry, has yet been completed; whether the Land Commission propose to clean the stream between the Studdert Estate and the Ormathwaithe Estate at Kiltean, County Kerry; whether any funds have been allocated for this purpose, and if not, whether, in view of the damage done by the flooding of this stream, steps will now be taken to prevent further flooding; whether he is aware that Lord Ormathwaite contributed towards the cost of cleaning his portion of the stream; that, before the vesting of the Studdert Estate in 1915, Lord Ormathwaithe withdrew his contribution, as Mr. Studdert had not contributed an equal amount; whether he can state the amount originally contributed by Lord Ormathwaithe; and whether his Department will now request Lord Ormathwaithe to contribute the sum which he previously withdrew.

The repairs to the embankments at Ballyoneen, on the estate of Thos. Studdert, which is being sold under the purchase provisions of the Land Act, 1923, are completed save for some minor work which is at present being carried out. The cleansing of the stream referred to was not included in the specification of repairs required to protect works on the Studdert estate, but owing to representations made by a Mr. Richard Woulfe, of Dromlough, Lisselton, who is a tenant purchaser on the Ormathwaite estate, and whose lands are affected by the upper portion of the stream in question, the Land Commission have had an investigation made by an inspector, whose report they are at present considering with a view to ascertaining what steps, if any, they can take in the matter.

The Land Commission have no information as to the contribution alleged to have been made in the past by Lord Ormathwaite towards the cleansing of the stream in question, and have no power to compel him to continue such contribution.
