Vol. 26 No. 1

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - INJURY TO GARRYLUCAS STRAND.

asked the Minister for Industry and Commerce whether he has received representations from the Cork County Council with regard to the damage being done to the Barrier at Garrylucas Strand, Old Head of Kinsale, by the practice of drawing loads of stones from it; whether he is aware of the danger resulting to life and property in that area if this is permitted to continue unchecked; and if he will state what steps it is proposed to take in the matter.

Representation was made to the Department in August last on behalf of the Cork County Council in regard to removals of materials from the foreshore at Garrylucas. It was stated that damage to the public road was likely to follow removals from the adjacent foreshore.

The shore at this place does not belong to the State, but should it be the case that the road was endangered, the Council would seem to have authority under Section 9 (5) of the Summary Jurisdiction (Ireland) Act, 1851, to prosecute the parties responsible. The Department drew the attention of the Council to this statutory provision, but has not subsequently been informed as to whether any prosecutions have been instituted.
