CEISTEANNA—QUESTIONS. ORAL ANSWERS. - DAMAGE TO PROPERTY—RECOMMENDATIONS SET ASIDE.

asked the Minister for Finance whether he will state the number of cases under the Damage to Property (Compensation) Act, 1923, in which, on the ground that the applicant was disentitled under Section 9 of the aforementioned Act, he set aside the recommendations made by judges under Section 15 of the Act, and further, whether he will state the total amount represented by the recommendations thus set aside.

In the case of 38 applicants in whose favour reports were made under Section 15 of the Damage to Property (Compensation) Act, 1923, payment was refused on the ground that the terms of Section 9 of the Act were applicable; the total amount, including costs and expenses, recommended for payment in these cases was £4,248 7s. 9d. I should add, however, that in a large number of these cases the refusal of payment was justified on grounds which do not depend on the terms of Section 9.
