Vol. 27 No. 4

CEISTEANNA.—QUESTIONS. ORAL ANSWERS. - DIVISION OF GALWAY LANDS.

asked the Minister for Lands and Fisheries whether the Land Commission, in dealing with the estate of Mr. John A. Lewis, County Galway, S. 1990, propose to compensate Mr. John A. Lewis as owner and also as tenant to himself for 71 acres 1 rood 31 perches in the townland of Cuilleendarragh, and also for 46 acres 2 roods 5 perches in the townland of Garraunphaudeen, being Nos. 99 and 100 on the retained list issued under date February 7th, 1928.

also asked the Minister for Lands and Fisheries if he will state why the Land Commission, while proposing to recognise Mr. John A. Lewis (owner of an estate in Co. Galway, Record No. S. 1990) as a judicial tenant to himself for 71 acres 1 rood 31 perches in the townland of Cuilleendarragh, and for 46 acres 2 roods 5 perches in the townland of Garraunphaudeen, excluded those two holdings from the provisional list of lands issued on February 2nd, 1926.

In the Schedules of Particulars lodged by the owner, J.A. Lewis, the lands referred to were returned as untenanted land, and accordingly were not included in the provisional list of tenanted lands published on 2nd February, 1926. It subsequently transpired that the lands were not untenanted, but were tenanted lands subject to judicial rents, the tenancy interests in which had been acquired by the father of the present owner and had not merged in the fee. They were published in a further provisional list of tenanted lands on 8th November, 1927, and notice of intention to retain the holdings was published on 7th February, 1928. The Land Commission propose to apply for an order authorising them to resume these holdings and fixing the resumption price thereof.
