CEISTEANNA.—QUESTIONS. ORAL ANSWERS. - VESTING OF KERRY LANDS.

asked the Minister for Lands and Fisheries whether he will state the cause of the delay in vesting the lands of Mr. Timothy J. Brassill, Collnagraigue, Ballylongford, Co. Kerry (Estate— Trinity College No. T. 183/29); whether he is aware that Mr. Brassill signed the purchase agreement in the year 1912, and whether he will state when it is proposed to take the necessary steps to vest the lands in the purchaser.

This estate is the subject of proceedings for sale by the vendors direct to the tenants under the Irish Land Acts, 1903-9, and purchase agreements in respect of 84 holdings have been signed by the parties and lodged in the Land Commission in 1912-1922.

The bulk of the turbary in the townlands of Aghnagran Middle, Leanamore and Gurteenacloona on this estate is within the ambit of the tenanted holdings, and the Estates Commissioners, after the inspector had visited the lands and furnished his report, required the vendors to prepare a turbary scheme of allotment with maps and schedules showing the turbary allotments for the tenants laid off, accompanied by the tenants' consents to accept such allotments. The vendors prepared a turbary scheme and the majority of the tenants signed consents accepting the exclusive right of turbary on their allotments in lieu of any claim to turbary under their purchase agreements or otherwise, and agreeing that said right of turbary should be vested in them and be consolidated with their holdings, but certain of the tenants refused to sign such consents.

In addition to this refusal three tenants on whose holdings the majority of the turbary allotments were situated have refused to sign consents to their holdings being vested in them subject to the right of the other tenants to cut turf on the allotments given them under the scheme prepared by the vendors. As repeated attempts by the Land Commission inspectors to obtain the outstanding consents have proved abortive the Land Commission have under consideration what action they will take as regards the turbary on this estate.

The vesting of the holdings in the tenants on this estate, including that of Timothy Brassill, is held up pending the settlement of the turbary question.
