Written Answers. - Standard Purchase Annuity of County Cork Holding.

asked the Minister for Lands and Fisheries if he will state if the holding of Robert T. Forrest, of Castleview, Blarney, County Cork, held as a future tenancy on the former estate of Sir George Oliver Colthurst, Bart., owner (No. S. 4867), and vested in the Land Commission on 1st May, 1931, has been inspected with a view to fixing the standard purchase annuity and, if so, when and with what result; if he is aware that this holding has been held on the terms of an English managed estate and that since 1923 the former landlord has failed to carry out his obligations in respect of the upkeep of the holding, with the result that the tenant has to pay more than 100 per cent. of the future tenancy profit rent, and in view of these circumstances is he in a position to state when the standard annuity will be fixed, and if same will be retrospective as from 1923.

Robert T. Forrest was returned as a tenant of a holding in Shane Upper and Shane Lower on the estate of Sir G.O. Colthurst, County Cork, at a rent of £324 6s. 6d. This holding was vested in the Land Commission on the 1st May, 1931, and the standard purchase annuity thereon was fixed under the provisions of Section 2 of the Land Act, 1929, at £210 16s. 3d. The tenant having objected to the said standard purchase annuity, the standard purchase annuity will be fixed by the Land Commission under Part 2 of the First Schedule to the Land Act, 1923, as soon as possible. This annuity will be retrospective to the Appointed Day, 1st May, 1931. The tenant states that this holding has been held on the terms of an English managed estate and that since 1923 the former landlord has carried out no improvements. The Land Commission have no power to vary the tenant's liability in respect of rent prior to the Appointed Day, being under statutory obligation to collect payment in lieu of such rent at the rate of 75 per cent. thereof up to the Appointed Day.
