Motion for Seanad Election, 1934.

I beg to move the Seanad Election motion:—

Dáil Eireann doth hereby resolve and decide that—

(1) The proposal and selection for nomination for so much of the panel as shall be nominated by Dáil Eireann for the purpose of the next election of members to Seanad Eireann shall be conducted in accordance with the Seanad election resolution, 1931, passed by Dáil Eireann on the 21st October, 1931, modified as follows:—

(a) The time for selection shall be the period commencing at the time of the passing of this resolution and ending on the 1st day of October, 1934, and the expression "time for selection" shall be construed accordingly;

(b) Rules 11 to 15, inclusive, of the said resolution shall not apply, and in lieu thereof the following rule shall have effect, that is to say:—

As soon as may be after the time for selection the returning officer shall cause to be sent to each Deputy, at the ordinary address, or to such other address as may be furnished by him, one voting paper and declaration of identity, and the rules in the Fourth Schedule to the Electoral Act, 1923, relating to postal voting and the forms prescribed therefor shall apply with the necessary modifications, and in particular the modification that the word "agent" where it occurs in the said Fourth Schedule shall mean a Deputy who may desire to be present and was either the proposer, seconder, or assentor to the nomination of a candidate.

(c) Any voting paper received after 12 noon on the 6th day of November, 1934, shall be disregarded;

(d) A Deputy who may desire to be present and who was either the proposer, seconder or assentor to the nomination of a candidate may attend the counting of the votes.

(2) This resolution may be cited as the Seanad Election resolution, 1934.

This motion incorporates the resolution passed by this House in 1931. This method of resolution by reference is not to be taken as a precedent, but in present circumstances the convenience of this method will be obvious.

Nominations for the panel to be formed by this House must be handed in on or before 12 noon on the 1st October next, and there are 23 names to be placed on the panel. If there are more than 23 nominations to the panel, it is not proposed to bring Deputies back to vote — this resolution provides that the voting may take place by post.

The Minister is aware that there is a casual vacancy in the Seanad. Can the Minister assure the House that this casual vacancy will be filled?

So that there will be a full Seanad which will be in a position to vote effectively in the Seanad election when it takes place?

I can assure the Deputy that the vacancy will be filled in time to allow the person elected to vote as an ordinary voter in the Seanad election.

Is the Minister in a position to state when he proposes to issue the order fixing the date of the by-election?

I think the date expires on the 21st August. It will be issued before then.
