Ceisteanna—Questions. Oral Answers. - County Cavan Court Warrant.

asked the Minister for Justice if he is aware that the Gárda Superintendent of the area stated as reported in the Press at Ballinagh (Cavan) District Court that he was instructed by the Minister not to execute a warrant issued by District Justice Lavery on May 18th last against Patrick Dalton, of Drumhownagh, County Cavan, although Patrick Dalton had not exercised his right of appeal against the District Justice's decision, and if he will state on what grounds and by what authority did he forbid execution of the warrant.

The procedure followed in this case was in accordance with what has always been the normal practice in cases where a petition for remission or mitigation is under consideration. In such cases the execution of the warrant is deferred until a decision has been given on the petition.
