Vol. 55 No. 17

Business of the Dáil.

Can I get permission to raise the matter of what, I consider, was an unsatisfactory reply to a question in my name on the Order Paper yesterday? I gave notice to raise the matter on the adjournment and Deputy MacEoin gave notice to raise another question. I understand that Deputy MacEoin consulted with you and I gave way to him yesterday. I wish to know now if I can raise my question on the adjournment this evening? It was No. 11 on yesterday's Order Paper.

I understand that in relation to that question, legal action is pending and in those circumstances, I do not think it is proper that it should be raised on the adjournment.

I accept your ruling. In view of the fact that you say a legal action is pending, could I get information covering the precise points in my question? Could I be informed if it is a question of assault in connection with the man named in the question or if the allegation is bearing on the grounds of excessive seizure? If it is a question of excessive seizure I cannot see how it could come except from the man from whom the goods were seized. State action would not be proper on these points. I would like a decision whether legal action on the question of assault would preclude my raising it.

The Deputy appreciates how necessarily circumscribed any discussion must be in view of pending legal proceedings.

Dr. Ryan

It would be worse to have the Deputy circumscribed.

I agree. I will take the matter up at another time when the Minister is out of trouble.
