SECTION 2.
The following amendment, No. 4, was in the name of Deputy McMenamin:—
In sub-section (1), line 51, to delete the words "whalebone or".

With regard to this amendment, Sir, a point is raised that the words "whalebone or" should be deleted, and that the sub-section should apply only to baleen whales. Perhaps the Minister would say briefly why it is considered that the words "whalebone or" should appear there.

The Chair also would welcome some information, since there is some doubt as to the relevancy of the amendment.

As a matter of fact, the whole world appears to be doubtful. In some countries whales are called whalebone whales, and in other countries they are called baleen whales. Even this international convention appeared to be doubtful as to what to call them, and therefore use both phrases. I think they are called baleen in some countries and whalebone in others, but I do not think that both names are applicable in any country.

I think, Sir, the Minister's intervention explains it, but the section, as it is drawn, appears, a little obscure without that explanation, because it did not appear at first reading that the word "whalebone" there was adjectival. It now appears that the word is an adjective and not a noun.

I suppose, Sir, it is not relevant on that section to inquire if it is prohibited to catch a whale in Lough Foyle?

That is a matter of interpretation of the measure on which the Minister might shed light.

I do not want to wander into irrelevancy, and I await your rebuke if I appear to do so, but I do think on this section, I would be in order in asking the Minister to say whether in his opinion it is prohibited by this section to catch a whale in Lough Foyle.

The Deputy is, seemingly, asking for a definition of territorial waters.

I would next inquire what part of Lough Foyle?

That is not in order.
