Private Business. - Draft Constitution—Application of Standing Orders.

I move:—

Orduítear leis seo maidir leis an Dréacht-Bhunreacht, 1937:—

1. Go dtuigfear, chun na gcrícheanna bhaineann le Dáil Eireann do bhreithniú an Dréacht-Bhunreachta, an Dréacht-Bhunreacht do bheith ina Bhille le n-a mbainfidh Buan-Orduithe Dháil Eireann i dtaobh Gnótha Phuiblí, ach na hoiriúnuithe seo leanas do dhéanamh ar na Buan-Orduithe bhaineann le Billí do rith agus le Billí do dheimhniú:—

(a) Buan-Ordú 83.—Isí tairisgint a déanfar ar an Dara Céim den Dréacht-Bhunreacht ná "Go léigtear an Dréacht-Bhunreacht, 1937, an Dara Huair anois."

(b) Buan-Ordú 84.—Nuair a bheidh an Dréacht-Bhunreacht léighte an Dara Huair, ordófar é bhreithniú i gCoiste den Dáil uile.

(c) Buan-Orduithe 86 go 92.— Déanfar tagairtí sna Buan-Orduithe d'ailt de Bhille do léiriú mar thagairtí d'Airtiogail den Dréacht-Bhunreacht agus deighleálfar leo dá réir sin.

(d) Buan-Ordú 96.—Isí Ceist a cuirfear ar Cheathrú Chéim an Dréacht-Bhunreachta ná "Go nglactar an Dréacht-Bhunreacht, 1937 (no an Dréacht-Bhunreacht, 1937, mar atá sé leasuithe) chun an breithniú deiridh do dhéanamh air."

(e) Buan-Ordú 97.—Isí tairisgint a déanfar ar an gCúigiú Céim den Dréacht-Bhunreacht ná "Go ndeinidh Dáil Eireann agus go ndeineann sí leis seo aontú leis an Dréacht-Bhunreacht, 1937."

2. Buan-Ordú 110.—Is mar seo leanas a bheidh an nós imeachta maidir le Cléireach Dháil Eireann do dheimhniú an Dréacht-Bhunreachta:—

(a) Chó luath agus a bheidh an tairisgint chun aontuithe leis an Dréacht-Bhunreacht rithte ag Dáil Eireann, déanfaidh Cléireach Dháil Eireann, no cuirfidh fé ndeár go ndéanfar, cóip de agus deimhneoidh le deimhniú i scríbhinn fé n-a láimh gur cóip dhílis chruinn an chóip sin. Luadhfar sa deimhniú sighnithe an dáta ar ar aontuigh Dáil Eireann leis an Dréacht-Bhunreacht.

(b) Dhéanfaidh Cléireach Dháil Eireann an chóip a bheidh deimhnithe amhlaidh do chur go dtí Uachtarán na hArd-Chomhairle.

3. Má eiríonn aon phone orduithe, maidir le léiriú an Orduithe seo no maidir le baint Bhuan-Orduithe Dháil Eireann i dtaobh Gnótha Phuiblí leis an Dréacht-Bhunreacht, le linn do Dháil Eireann é bhreithniú, ní bheidh dul thar breith an Chinn Chomhairle, no an Leas-Chinn Chomhairle, do réir mar a bheidh.

It is hereby ordered in regard to the Draft Constitution, 1937:—

1. That for the purposes of the consideration of the Draft Constitution by Dáil Eireann, the Draft Constitution shall be deemed to be a Bill to which the Standing Orders of Dáil Eireann relative to Public Business shall apply, with the following adaptations of the Standing Orders having reference to the passing of Bills and to the vouching of Bills:—

(a) Standing Order No. 83.— The motion to be made on the Second Stage of the Draft Constitution shall be "That the Draft Constitution, 1937, be now read a Second Time."

(b) Standing Order No. 84.— When the Draft Constitution has been read a Second Time, it shall be ordered to be considered in Committee of the whole Dáil.

(c) Standing Orders No. 86 to No. 92.—References in the Standing Orders to sections of a Bill shall be construed as references to Articles of the Draft Constitution and shall be treated accordingly.

(d) Standing Order No. 96.— The Question to be put on the Fourth Stage of the Draft Constitution shall be "That the Draft Constitution, 1937 (or the Draft Constitution, 1937, as amended) be received for final consideration."

(e) Standing Order No. 97.— The motion to be made on the Fifth Stage of the Draft Constitution shall be "That the Draft Constitution, 1937, be and is hereby approved by Dáil Eireann."

2. Standing Order No. 110.—The procedure for the vouching of the Draft Constitution by the Clerk of Dáil Eireann shall be as follows:—

(a) So soon as the motion for the approval of the Draft Constitution shall have been passed by Dáil Eireann, the Clerk of Dáil Eireann shall make, or cause to be made, a copy thereof, and shall vouch such copy to be a true and correct copy by certifying the same in writing over his own hand. The signed certificate shall state the date of the approval by Dáil Eireann of the Draft Constitution.

(b) The copy so certified shall be forwarded by the Clerk of Dáil Eireann to the President of the Executive Council.

3. On any point of order arising on the interpretation of this Order or on the application of the Standing Orders of Dáil Eireann relative to Public Business to the Draft Constitution, during its consideration by Dáil Eireann, the decision of the Ceann Comhairle, or the Leas-Cheann Comhairle, as the case may be, shall be final.

The Committee of Procedure and Privileges has agreed to the Order contained in this motion. The effect of it will carry out the Government's purpose to give adequate opportunity to the Dáil to discuss the terms of the Draft Constitution in detail. When the proposal reaches the Final Stage, the Draft Constitution will not be passed as an Act but will be approved for recommendation to the Irish people for enactment by them.
