Ceisteanna—Questions. Oral Answers. - Local Authorities Transferred Officers.

asked the Minister for Industry and Commerce if he has had under consideration the position as regards conditions of employment and security of tenure, of whole-time pensionable officers of local authorities who were transferred under the provision of Section 39 (9) of the Electricity (Supply) Act, 1927, to the service of the Electricity Supply Board; and whether he is prepared to introduce legislation to amend the Electricity Supply Acts so that such transferees will be considered to have become servants of the Electricity Supply Board upon the same terms as they were, on the 31st day of March, 1927, employed by the local authority.

The position as regards conditions of employment and security of tenure of whole-time pensionable officers of local authorities who were transferred under the provisions of Section 39 (9) of the Electricity (Supply) Act, 1927, to the service of the Electricity Supply Board is clearly defined in the provisions of Section 39 of the Act referred to and it is not my intention to amend these provisions in any way.

Is the Minister aware that an officer transferred from a local authority to the Electricity Supply Board was dismissed without the sanction of the appropriate Minister and that this dismissal was not in keeping with the terms of his original appointment under the local authority?

I am not aware that any officer was dismissed by the Electricity Supply Board without good cause.

If I supply the Minister with details, will he give an undertaking to investigate the case with a view to securing a readjustment?

If the case the Deputy has in mind is the same as the case I have in mind, I could not give such an undertaking.
