Ceist—Question. Oral Answer. - Settlement of Disputes.

asked the Minister for Justice if he is aware that the law regulating the settlement of disputes by arbitration is substantially out of date, and, if so, if it is his intention to introduce legislation to remedy this unsatisfactory state of affairs.

I understand that the question of arbitration is one of the matters which have been noted by the Superior Court Rules Committee for consideration pursuant to Section 75 of the Courts of Justice Act, 1936. Any recommendation which the committee may make will receive immediate attention.

I was referring not so much to rules as the bringing in of entirely new legislation because, the Minister may be aware, that practice is now regulated by the Common Law Procedure Act of 1856, which is, one might almost say, 100 years old. It is out of date. I am not asking the Minister to bring in legislation immediately, but I would ask him to consider the matter and see if he cannot at some future time bring in legislation.

May I point out to the Deputy that that is also a matter for this Superior Court Rules Committee? In addition to the rules, they inquire into the initiation of suggested legislation. I believe this is one of the matters they are considering.
