Vol. 80 No. 16

Ceisteanna—Questions. Oral Answers. - Acquisition of Laoighis Estate.

asked the Minister for Lands if he will state whether he has received repeated applications for the acquisition and division of the O'Brien estate, Ballydavis, Portlaoighise, County Laoighis; what is the cause of the delay in preparing a division scheme for these lands; and if and when the lands mentioned are likely to be divided.

The estate in question appears to comprise two holdings in the townland of Ballydavis in the occupation of the representatives of James O'Brien on the Kemmis estate, Record No. S.3780. Notices of intention to apply to the Appeal Tribunal for leave to resume one of these holdings containing 5 acres and a portion of the other holding containing 100 acres, 1 rood, 21 perches were served by the Land Commission on the persons interested in the lands. As all these persons did not consent to a resumption order being made, further proceedings were held up owing to an adverse judicial decision which governed this case among others. It is proposed to publish fresh notices pursuant to Section 39 of the Land Act, 1939, as soon as practicable, but it cannot be stated at present whether or when the lands will be resumed and divided.
