Ceisteanna—Questions. Oral Answers. - Roscrea Turbary.

asked the Minister for Lands why, when the turbary on the McIvor estate, Golden Grove, Roscrea, now in possession of the Land Commission, was being let, Mr. William Bourke, Mill Park, Roscrea, tenant on this estate, was precluded from obtaining turbary there.

All applications for seasonal turbary lettings on the McIvor estate were duly considered by the Land Commission, but owing to the restricted area available Mr. Bourke could not be provided with a bank this season.

Will the Minister say why people who have plenty of turbary and are not living on the estate were provided with turbary? Is it not usual for the Land Commission to provide the tenants on an estate, especially those to whom they gave land or who took conacre on the estate with turbary?

This is not the permanent scheme; this is only an allotment of turbary for the present season.

It was allotted by the inspector to people who already had turbary and to people who are not entitled to it. Besides that, this man was brought up under the criminal law instead of prosecuting him for trespass. I wonder if the Minister agrees with that procedure in the case of a small farmer?

The Deputy has raised two separate questions and I do not propose to answer them.
