Ceisteanna—Questions. Oral Answers. - Rates on Soldiers' Dwellings.

asked the Minister for Local Government and Public Health whether he is aware that the Dublin Corporation have recently caused demand notes for rates and arrears of rates to be served on the occupiers of soldiers' houses in Sandymount and Kimmage and have threatened immediate distraint on such occupiers; that no demand for such rates has been served since the year 1937 and that the full three years' arrears are now being demanded; and whether in view of the facts that such arrears accrued by reason of doubts that existed as to the liability of such occupiers for rates, and that such occupiers have offered payment by instalments commensurate with their means, he will request the corporation to postpone the full and immediate enforcement of the amount of such rates and arrears.

I understand that demand notes have been served on the occupiers every year by the rate collectors and that where rates had not been paid proceedings have been taken to recover the amount of rates due. There can be no question of the liability of the occupiers of houses which are not small dwellings since the court refused a declaration in 1939 that the houses were exempt from rates as being used for charitable purposes. I understand that where reasonable offers to pay the arrears in instalments have been made they have been accepted. I have no power to interfere with the execution of decrees. The matter rests entirely with the corporation.
