Committee on Finance. - County Management (Amendment) Bill, 1942—From the Seanad.

The Dáil went into Committee to consider an amendment from the Seanad.

I move that the Committee agree with the Seanad on the following amendment:—

SECTION 3.

In page 3, at the end of the section, a new sub-section added as follows:—

(4) Every Order made by the Minister under sub-section (1) of this section in respect of a board or committee which is in existence at the passing of this Act—

(a) shall be laid before each House of the Oireachtas as soon as conveniently may be after it is made, and

(b) may be annulled by either such House by resolution passed within the next twenty-one days on which that House has sat after such Order is laid before it, and

(c) shall (unless so annulled) come into force at the expiration of the time within which it may be so annulled or, where a date is specified in such Order for its coming into force, on that date or at the said expiration, whichever is the later.

The purpose of this amendment is to ensure that any Order made under Section 3 of the County Management (Amendment) Bill shall be considered by both Houses of the Oireachtas, if they so desire, before the Order comes into operation, and that if a decision is come to by either House the Order may be annulled by resolution. In view of the terms of the amendment, and of the need to get this Bill through as soon as possible, I should be grateful to the House if it could see its way to accept the amendment to-day.

There is no objection to that. Would the Minister refresh the memory of the House by indicating what class of local authorities are likely to be affected by Section 3 under this amendment?

Section 3 of the Bill is in fairly general terms. Practically any body, other than a pier or harbour authority or a vocational education committee, can be affected under Section 3. The amendment provides that in respect of a board or committee which is in existence at the date of the passing of this Act every Order made by the Minister shall be laid before each House of the Oireachtas and may be annulled by either House by a resolution passed within the next 21 sitting days. The Order, unless so annulled, may come into force at the expiration of that time, or if annulled shall not, of course, come into operation.

Would the Minister say when he intends to put the Act into operation?

As soon as possible.

What does that mean?

That may mean the 1st October.
