Mr. Kelly

asked the Minister for Lands if he will state whether the Land Commission has resumed the holdings of John Duddy, on the Daniell estate (No. S799), Moyleggan, Batterstown, County Meath; and, if so, when he expects to have the holding divided among the eligible local applicants.

The Land Commission published, on the 27th January, 1942, a notice of intention to apply to the Appeal Tribunal under the provisions of Section 39, Land Act, 1939, for leave to resume the holding of Jane Duddy, lands of Moyleggan on the Daniell estate. A petition, dated 26th February, 1942, praying that the holding be not resumed without further inquiry, was lodged on behalf of the tenant, and was refused by order of the Land Commission on the 5th ultimo. It is not possible at present to state when the holding will be resumed and divided.
