asked the Minister for Lands if he is aware that the road through the Corbally estate, Rath, Swords, County Dublin, is in an extremely bad condition at the moment, and that consequently grocery suppliers, etc., have refused to make deliveries to the people residing on this road; and if he will take steps to have this road put into a proper state of repair.

The road referred to which joins the county roads in the townlands of Lispopple and Surgalstown North was constructed by the Land Commission over three years ago, at a cost of £1,000. The damage to the road is stated to have been caused by the transport of road material by heavy lorries for the Dublin County Council from their quarry at Donabate. The Land Commission decided to spend a sum of £62 on repairs provided the county council agreed to take over and maintain the road. The county council stated that it would cost £1,000 to put it in a proper state of repair, and they refused to take it over unless the Land Commission contributed at least half of this amount. The Land Commission were not prepared to make this large contribution, but decided to proceed with their original intention of repairing the road provided the allottees agreed to sign a maintenance undertaking in respect of it.

The general rule is that the allottees, not the Land Commission, are responsible for the maintenance of accommodation roads made for their benefit.
