Ceisteanna—Questions. Oral Answers. - Acquisition of Limerick Lands.

asked the Minister for Lands if he will state the reason for the failure of the Land Commission to take over for division the lands of Mr. Danaher, Park, Monemohill, County Limerick; and when it is intended that they will be taken over and divided.

Owing to the emergency the Land Commission are not at present in a position to prepare a scheme for the division of the lands of Park on the Danaher estate and have deferred taking possession. It is not possible to state when the lands will be taken over and divided, but it is not intended to take possession during the present season.

Can the Minister say what caused the Land Commission to alter the decision which was communicated in a reply last year, that these lands would be taken over in November, 1942? What has happened since to prevent the Land Commission giving effect to that decision? Can the Minister tell the House why the lands were not taken over seeing that a scheme to do so was prepared six years ago?

The Deputy is not correct in saying that a scheme was prepared. He was informed on July 1st, 1942, in reply to a question that pending preparation of a detailed scheme the Land Commission was not in a position to indicated when these lands would be divided. It is true that it was indicated that possession of the lands would be taken in November last, but that has not been found possible, and the taking of possession had to be deferred.

Is it true that the Land Commission was to take possession of the lands on the 1st February last and, if so, for what reason was the decision postponed?

It was not found possible to take possession, and the Land Commission, having considered the circumstances of this case, decided to postpone doing so for a further period.

Will the Minister inquire into the matter? Is it not a fact that a scheme for the division of these lands was prepared by the Land Commission six years ago? Why not give effect to the scheme that was prepared then, or why was it postponed?

The postponement was only of a limited character up to the present. It may be possible to take possession if the lands have been the subject of negotiation over a long period. The Deputy was informed last year that a scheme had not been prepared, but that the preparation of a scheme was about to be considered. In fact, a scheme has not yet been prepared.

asked the Minister for Lands if he will say when it is intended to take over for division the lands of Mr. Leonard, Rathnasare, Rathkeale, County Limerick, which have been under consideration for the past seven years.

A notice of intention to apply to the Appeal Tribunal for leave to resume the holding of Richard Leonard, in the townland of Rathnasare, was published by the Land Commission on the 17th February, 1942. Further proceedings are suspended owing to emergency conditions.
