Ceisteanna.—Questions. Oral Answers. - Tillage on Mulhuddart Estate.

asked the Minister for Agriculture if he is aware that Messrs. Collis and Ward, solicitors for the Kirkpatrick estate, Coolmine, Mulhuddart, have served notice on the owner of the estate, Mr. Corcoran, to the effect that they will place a fine of £10 per acre on all land tilled on this estate, other than the land known as the Pig Field, Lodge Field and Orchard Field, and, further, that he will not be allowed to till more than the minimum amount required under the Compulsory Tillage Order; and if the Minister is prepared to deal with this matter by recommending the Government to issue an Order under the Emergency Powers Act dealing with the lease of the Kirkpatrick estate.

I have seen a copy of the notice served on the occupier of lands on the Kirkpatrick estate at Coolmine, County Dublin, limiting, subject to penalty, cultivation on the holding to certain fields mentioned in the question. Article 13 of the Emergency Powers (No. 234) Order, 1942, provides that no such restriction incorporated in any covenant or agreement affecting the lands shall have effect so as to interfere with the cultivation required by the Order. There is, therefore, no necessity for any action by me at this stage. I understand that the occupier has, in fact, arranged to cultivate an area in excess of the prescribed quota for the current year.
