Ceisteanna—Questions. Oral Answers. - Flooding of Lands.

asked the Minister for Lands if he is aware that considerable financial loss has been inflicted on tenants residing on the Marshall Estate at Callinafercy, Milltown, County Kerry, as a result of the constant floodings of those lands; and, if so, if he will arrange to have the collection of the annuities postponed pending relief of the flooding referred to.

I would refer the Deputy to the reply given to his previous question of 13th March, 1945, in this matter. The Land Commission are not responsible for the repair or maintenance of the sea or river embankment on the Leeson Marshall Estate at Callanafercy, and they are under a statutory obligation to collect instalments of land purchase annuity as they accrue due.

asked the Minister for Lands if he will state if, in cases where lands are being flooded periodically, because of the failure of the Land Commission to carry out the necessary repairs to the embankments protecting such lands, and where the tenants of such lands are entitled to such protection under the provision of the Land Acts, he is prepared to grant them some relief in respect of the payment of annuities.

Where the Land Commission are responsible for the maintenance of embankments they endeavour to have repairs carried out as expeditiously as conditions and circumstances permit, and I am not aware of any failure or undue delay on their part in undertaking necessary repairs in any such cases.

Except where the provisions of Section 37 of the Land Act, 1933, are applied to annuities on lands permanently submerged, the Land Commission are under statutory obligation to collect instalments of land purchase annuity as they accrue due.
