Courts of Justice (District Court) Bill, 1946—From the Seanad.

The Dáil went into Committee to consider amendments from the Seanad.

I move that the Committee agree with the Seanad in amendment No I:—

Section 19: At the end of the section the following new sub-section inserted:—

(3) Whenever a justice is removed from office on account of incapacity, he shall be deemed for the purposes of pension to have vacated his office owing to permanent infirmity.

This is a provision that was contained in Section 49 of the 1936 Act and when that Act was repealed we neglected to make provision for the case covered in the amendment. I rectified that by bringing in the amendment in the Seanad.

Has the Minister made any headway in regard to the question of the rate of pensions for justices?

That is a different matter. I did not do anything about that. This is merely to provide——

I know what it is meant to provide. The Minister has not considered the other question?

Mr. Boland

I considered it. I did not do anything about it. I could not do anything about it.
