Ceisteanna—Questions. Oral Answers. - Opening of Licensed Premises.

asked the Minister for Justice if he is prepared to introduce proposals for legislation to amend Section 4 of the Intoxicating Liquor Act, 1943, so as to give the great majority of the citizens of this country the same facilities with regard to the opening of licensed premises as are available to the citizens of Cork and Dublin.

The answer is in the negative.

Is the Minister aware that this is a penal enactment, that it is class legislation and that it is repugnant to Article 40 of the Constitution? In view of that, will he seize the remedy?

Mr. Boland

If the Deputy thinks it is repugnant to the Constitution, he has his remedy and can go to the courts.

We will try it out with you in the courts.

Mr. Boland

That is another day's work.
