Ceisteanna—Questions. Oral Answers. - Military Service Pension Appeals.

asked the Minister for Defence if he will state, in relation to the Military Service Pensions Acts, 1934 to 1946: (a) the number of appeals received prior to 31st December, 1945; (b) the number referred back to the Referee; (c) the number of cases in which the Referee altered his previous decision and made awards; (d) the number of appeals rejected by the Referee; (e) the number of appeals pending rehearing by the Referee; (f) the number of appeals rejected by the Minister; (g) the number of appeals still under examination by him and pending decision; and (h) whether the appeals mentioned at (f) and (g) will be referred back to the Referee or rejected by the Minister on the grounds that they do not contain additional evidence that was not available at the previous hearing.

The answer to the Deputy's question is as follows: (a) 4,242; (b) 1,272; (c) 552; (d) 482; (e) 238; (f) 2,960; (g) 10; (h) the appeals mentioned at (f) have been rejected by me on the grounds that they do not contain evidence which was not already available prior to the issue of the Referee's report. In regard to the cases mentioned at (g), I can refer back to the Referee only those appeals containing evidence which was not available prior to the issue of the Referee's report. The appeals which do not satisfy this condition will be rejected by me.
