Ceisteanna—Questions. Oral Answers. - Cork Man's Death.

asked the Minister for Justice if he is prepared to revoke the Order (made by his predecessor) prohibiting the holding of an inquest on John Joseph Kavanagh, St. Declan's Road, Gurrane Braher, Cork, an unarmed man who was shot dead by armed Gardaí on the afternoon of the 3rd August, 1940.

An Order prohibiting the holding of an inquest was not made in this case and an inquest was held. An Order was made applying Article 3 of the Emergency Powers (No. 47) Order, 1940, to the inquest. The effect of this was to provide for the holding of the inquest without a jury, the restriction of evidence to evidence of identification and medical evidence, and to restrict the verdict to the direct cause of death as established by the medical evidence.

Am I to understand that the circumstances surrounding the death of this man have never been investigated by any tribunal?
