Ceisteanna—Questions. Oral Answers. - Repair of Embankments.

asked the Minister for Lands whether the Land Commission propose to complete the repairs they have been carrying out to the river embankment and sluices adjoining the holding of Mr. Morgan Flaherty, Coill, Listowel, in the Ormathwaithe estate, in view of the fact that the work carried out up to now by the Land Commission has caused flooding to the lands of Mr. Flaherty and others, and that the commission have stated that they may increase Mr. Flaherty's annuity.

It is incorrect to state that the flooding of the lands in question resulted from improvement works carried out by the Land Commission.

In 1948 the Land Commission repaired the sluice and embankment on Mr. Flaherty's holding, although they had no liability in the matter. After the repairs had been effected and in spite of warnings, Mr. Flaherty allowed his cattle to trample on and damage the embankment. The Land Commission have decided to repair it again, provided Mr. Flaherty and the two other tenants affected contribute towards the cost. When the Land Commission proposals are accepted the work will be put in hands.

I take this opportunity to state that I will not expect the Land Commission to repair embankments which the tenants allow to be damaged by their own stock.
