Ceisteanna—Questions. Oral Answers. - Pension for ex-Garda.

asked the Minister for Justice if he will indicate the reasons why a disability pension was refused by his Department to ex-Garda 4215 and whether he will have the facts of the case relating to discharge on medical grounds of this man sympathetically reconsidered with a view to granting him a disability pension.

The ex-Garda resigned from the Garda Síochána on 7th December, 1938. He was not discharged on medical grounds and, consequently, was not eligible for the award of a pension under the Garda Síochána Pension Orders.

Is the Minister aware that the Department concerned recommended this man for a disability pension but that subsequently some legal question was raised by the Department of Finance? In view of all the circumstances I would ask the Minister if he can see his way to arrange a review of the case and to see that justice is done to this man.

I am not aware of these things.
