Ceisteanna—Questions. Oral Answers. - Land Acquisition and Division.

asked the Minister for Lands if he will state what is the present position regarding the estate of approximately 400 acres at Graigeddar, Kilcock, County Kildare, at present owned by the Department and on which nine houses have been built, why six migrants have been established there recently although there are several deserving applicants in the locality and whether the remaining six farms will be allotted to local applicants; and, if so, when it is hoped to have this done.

This estate comprises 339 acres. Seven migrants and an ex-employee have been allotted holdings on it. I cannot say when the balance of the lands, comprising 59 acres, will be allotted.

The Land Commission, at their discretion, decided the nature and extent of the various allotments after full consideration of all the applicants.

In view of the fact that in this area there are very deserving applicants, would the Minister ask the Land Commission to give sympathetic consideration to their applications for portion of the remaining lands?

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate at Badger Hill, County Kildare, approximately 80 acres already in the possession of the commission and when it is hoped to have the lands divided amongst the many deserving applicants in the locality.

I presume this question refers to the lands of Badger Hill in County Dublin.

The Land Commission are not in a position to state when these lands will be allotted.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of Mr. Brophy at Herberstown, Two-Mile-House, County Kildare, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of 200 acres approximately, described as the Harrington estate, Castlewarden, Kill, County Kildare, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of 100 acres at Clownings, Straffan, County Kildare, owned by Mr. John Dardis, Newbridge, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of approximately 200 acres at Sallymount, Kilcullen, County Kildare, the property of Prince Aly Khan, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. John Corrigan at Corbally, County Kildare, of approximately 135 acres, amongst the many local deserving applicants, and the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Plewman at Glasealy, Ballitora, County Kildare, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided, consisting of approximately 210 acres.

I propose to take together Questions Nos. 6 to 11 inclusive. The Land Commission have decided not to acquire these lands.

May I take it from the Minister's reply that this decision is final and that the Land Commission will not be prepared to have these cases reinvestigated?

No; it would be wrong to take it that the decision is final. When the Land Commission examine any particular case and decide to take no further action, that does not preclude them from reopening it when and if they like.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. A. J. Hemmingway at Clane, County Kildare, of approximately 300 acres, amongst the many deserving local applicants, the date of the last inspection and when it is hoped that the lands will be divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to dividing the lands of the Coleman estate of approximately 300 acres at Killekether, Kilcock, County Kildare, amongst the many deserving local applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to division of the lands of Mr. John Brennan, Two-Mile-House, County Kildare, of approximately 80 acres, amongst the local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the Kelly estate at Maddenstown, County Kildare, approximately 400 acres, the date of the last inspection and when it is hoped to have the lands divided amongst the many deserving applicants in the locality.

Proceedings are in progress for the acquisition of all or parts of the various estates referred to.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. Broe at Reeves, Straffan, County Kildare, of approximately 200 acres, amongst the many local deserving applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to acquiring the lands known as the Charter Grounds, Carbury, County Kildare, of approximately 19 acres for use as a cowpark for the use of approximately 26 local people, the date of the last inspection, and when it is hoped that the lands will be acquired.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of 418 acres of Mrs. Ashmore, Moorehill, Brannockstown, County Kildare, and which has lately been sold to an English purchaser, amongst the many local deserving applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. Thomas Boylan at Clonkeeran, Carbury, County Kildare of approximately 300 acres, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Miss Maria Murphy at Ardkill, Carbury, County Kildare, of approximately 200 acres, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. Ashe, Narraghmore, County Kildare, of approximately 1,000 acres, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the-lands of New Abbey, Kilcullen, County Kildare, of approximately 640 acres, which was owned by the late Lord Glentoran and presently owned by Mr. Kenneth Urquhart, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. C. Brophy of Dowdingstown, Two Mile House, County Kildare, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

I propose to take together Questions Nos. 17 to 24, inclusive.

The Land Commission have no proceedings in respect of these lands, but the several cases mentioned have been noted already for consideration.

In connection with Question No. 22, which relates to a farm comprising over 1,000 acres, will the Minister be prepared to request the Land Commission to give special and immediate consideration to the division of this farm? Surely the Minister cannot dispute the fact that there are numbers of deserving applicants who are only too willing to take holdings on this farm?

The Deputy, I am afraid, is wrong when he says there are 1,000 acres there. The Land Commission have proceedings in respect of 358 and 567 acres—two lots—respectively.

I am not far out at all. As regards Question No. 23, might I ask the Minister to request the sympathetic consideration of the Land Commission in connection with the lands of the late Lord Glentoran, in view of the congestion that exists in that neighbourhood? Will he request them to give this case their special consideration?

Is that a stud farm?

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of the Coates estate of Knockanally of approximately 400 acres at Kilcock, County Kildare, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of approximately 350 acres at Blackhall, Clane, County Kildare, owned by Messrs. Myerscough and Company, amongst the many local deserving applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of 260 acres at Athgarrett, Ballymore Eustace, County Kildare, owned by the late Senator Fanning, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the Hawkins estates at Kildare, County Kildare, as follows: (a) 150 acres at Pollardstown; (b) 75 acres at Rathbride; (c) 150 acres at Milltown; (d) 300 acres, O'Neill's and (e) 70 acres at Rossmore, amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mr. William Osborne at Punchestown. County Kildare, of approximately 130 acres amongst the many deserving local applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of approximately 160 acres at Castlewarden, Kill, County Kildare, already in the possession of his Department, amongst the many deserving applicants in the locality and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of the Carson estate of approximately 560 acres at Ballycannon, Kilcock, County Kildare, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of Mr. John Corrigan at Abbeyawn, Kilcullen, of approximately 100 acres, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands at Rathwalkin, Kildare, County Kildare, of approximately 200 acres owned by the Gibson estate, Rathwalkin, Kildare, amongst the many deserving applicants in the locality, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the estate of approximately 300 acres at Turnings, Straffan, County Kildare, owned by Mr. Mills, Straffan, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mrs. Doyle, The Chair, Kildare, County Kildare, of approximately 212 Irish acres, amongst the many deserving applicants in the locality, the date of the last inspection, and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the Darley estate of approximately 600 acres at Kill, County Kildare, owned by Mr. Claud Odlum, amongst the many local deserving applicants, the date of the last inspection and when it is hoped to have the lands divided.

asked the Minister for Lands if he will state what progress has been made by the Land Commission with a view to the division of the lands of Mrs. Broomfield, Stonebrook, Ballymore Eustace, County Kildare, the date of the last inspection and when it is hoped to have the lands divided amongst the many deserving local applicants.

I propose to take together Questions Nos. 25 to 38, inclusive. The Land Commission have no proceedings in these cases.

Does that mean that there are no proceedings at the moment, but that there may be proceedings for the acquisition of these lands in the future?

That seems to be the case exactly.

I am glad to have that on record.

In view of all these questions, may I ask the Minister is there any farm left in Laois-Offaly in regard to which Deputy Flanagan has not made representations to have it acquired?

There are quite a number of farms in Wicklow to which I would like to direct the Minister's attention.

Are we to take it that the principle of fixity of tenure is completely abrogated in the Deputy's area?

I will consider that.

With regard to the Deputy's last question, as it is a question which might have serious repercussions, I would like to point out that the consideration of particular lands to be acquired is vested entirely in the commissioners.

We have heard that too often.

We know that.

I want this to be clear. I do not want the impression to get about that any person outside the commissioners has the power.

May I express the hope that the Minister will not assert again that he is merely the office boy of the Land Commission?

That is a mistake.

Is the Minister aware——

The man who always fought for the three F.s.

Might I ask what further function in the Land Commission has the Minister besides sending for the hall porter, because that is the only function he has?
