Ceisteanna—Questions. Oral Answers. - Town Planning Difficulties.

asked the Minister for Local Government whether he is aware that because of the operation of Section 9 of the Summary Jurisdiction (Ireland) Act, 1851, a local authority is deprived of any right to determine minimum distance from the centre of a public road for which town planning approval can be given; that this causes difficulty when a local authority is waiting to grant town planning approval in remote places; and, if so, if he will consider introducing the necessary amending legislation.

I do not consider that the provisions of the section referred to impose any unreasonable restriction which would justify the introduction of amending legislation. It is open to a particular planning authority to deal with the matter under Section 44 of the Town and Regional Planning Act, 1934.
