Ceisteanna—Questions. Oral Answers. - Statutory Instruments and Orders.

asked the Minister for Finance if he will state in respect of each Department (a) the number of statutory instruments made, and (b) the number of other orders or directions having the force of law made during each of the last five years.

As the reply to (a) of the question is in the form of a tabular statement, I propose, with your permission, a Cheann Comhairle, to have it circulated in the Official Report.

As regards (b) of the question, the task of searching in each Department for all directions having the force of law made in the last five years would be too great and would involve too much time and labour. This does not necessarily imply that very large numbers of directions have been made, but simply that the search for such directions would be a rather formidable task. If the Deputy wishes to ascertain the number of directions affecting the public generally which were made under particular statutes or statutory instruments, he might consider putting down questions to the Ministers concerned.

(a) The expression “Statutory instrument” as used in this statement has the meaning assigned to it in the Statutory Instruments Act, 1947, viz., an order, regulation, rule, scheme or by-law made in exercise of a power conferred by statute.

(b) Published outside the officially numbered (S.I.) series of statutory instruments.

(c) Does not include orders made by the Revenue Commissioners approving or prescribing forms for Revenue purposes, as the question of whether such orders are statutory instruments within the meaning of the Statutory Instruments Act, 1947, is not free from doubt.
