Vol. 184 No. 1

Ceisteanna—Questions. Oral Answers. - Actions against Public Authorities.

65.

asked the Minister for Local Government if he will consider introducing legislation for the abolition of the doctrine whereby at common law no action lies against a public authority entrusted with the care and maintenance of highways for damages suffered in consequence of its omission to perform its statutory duty of keeping the highway in repair.

Legislative proposals on the lines suggested are not at present contemplated.

In view of the large number of vehicles now on the public roads and in view of the fact that the Minister's counterpart in Britain is considering an amendment of the legislation, would the Minister look into the matter further?

May I say that I looked into this matter exhaustively and that I am also aware of the move in Britain sponsored by a private member, to make some such change in the law there? However, I am not satisfied that it would be in the best interests of those concerned to make these changes here in the immediate future.
