asked the Minister for Health if health authorities may by resolution direct a county manager (or chief executive officer) not to impose the maximum charge of 10/- per day under section 15 of the Health Act, 1953, in relation to certain specified classes of persons such as (a) married persons, (b) insured workers, (c) persons in receipt of social welfare benefit, or (d) workmen's compensation cases; and, if so, if health authorities may by resolution direct a county manager (or chief executive officer) in the exercise of individual health functions not to charge more than the maximum charge mentioned in the resolution in lieu of the maximum charge of 10/- per day.

I would refer the Deputy to the provisions of Section 4 of the City and County Management (Amendment) Act, 1955 which deals with this matter. Any dispute as to the validity of a resolution such as the Deputy has in mind would fall to be determined by the Minister for Local Government or by the Minister for Health according to the particular circumstances. The Deputy will, accordingly, appreciate that it would not be appropriate for me, at this stage, to express a view about the matters mentioned in the question.
