Hospitals Federation and Amalgamation Bill, 1961—Committee Stage.

SECTION 1.
Question proposed: "That Section 1 stand part of the Bill."

This is the interpretation section, Sir.

This section provides for the appointment of a day to be the establishment day, the day the federation will be formed.

SECTION 3.

I move amendment No. 1:

In subsection (3), page 5, line 12, to delete "or" where it occurs before "any Act" and substitute "in".

The purpose of this amendment is to correct what I think might be described as a typographical error. It proposes to delete "or" and substitute "in."

Section 3 provides for the appointment of a day to be the transfer day.

SECTION 4.
Question proposed: "That Section 4 stand part of the Bill."

Section 4 provides for the establishment of a group which will be known as the Federated Dublin Voluntary Hospitals.

SECTION 5.
Question proposed: "That Section 5 stand part of the Bill."

Section 5 provides for the establishment on the establishment day of the Central Council of Federated Dublin Voluntary Hospitals. This Council will perform the functions assigned to it under the provisions of the Act. May I say for the benefit of Deputy O'Higgins who has just come into the House that we are on Section 5? There was one minor amendment which was merely a verbal change. It was of no significance.

I take it that the Minister has had the necessary and appropriate discussions with the persons interested. I have little doubt that this represents——

Absolutely. We have had an opportunity of reconsidering the Bill since Second Reading.

Perhaps the Minister can help me. I do not know if this is the appropriate time to raise the matter, but I am concerned with the point made by Deputy Dillon on Second Reading, with regard to the employees.

We have met that in an amendment to the Schedule.

SECTION 6.
Question proposed: "That Section 6 stand part of the Bill."

This section provides a new entity, the hospital board, for each participating hospital to replace the existing governing body. The members of the board will comprise the persons who, immediately before the establishment day, constituted the governing body of the said hospital.

SECTION 7.

I move amendment No. 2:

In subsection (1), page 6, line 28, to delete "college or body" and substitute "university, college or other institution".

The purpose of this amendment is to delete "college or body" and substitute "university, college or other institution" in the last line of subsection (1). Earlier in this subsection, we see the words "university, college or other institution." The amendment is designed merely to ensure that this form of expression will be carried right through.

What does "institution" mean?

The College of Surgeons, perhaps.

That would not be covered by "college"?

Yes. There is a comma after "university" in the amendment: "university, college or other institution".

I suppose the Apothecaries Hall is covered?

I should not like to commit myself because frankly I do not know. It might be. It is an institution.

It is not intended to exclude it?

No. The idea of the section is to give the new body the widest possible powers of association.

I move amendment No. 3:

In subsection (7), page 7, line 25, to delete "ordinary members" and substitute "members appointed by hospital boards".

This is a drafting amendment to delete the expression "ordinary members" and substitute the expression "members appointed by hospital boards".

I move amendment No. 4:

In subsection (10), page 8, to delete "college or body" in lines 20 and 22 and substitute in each case "university, college or other institution".

This amendment serves the same purpose as amendment No. 2.

I move amendment No. 5:

In subsection (10), to delete paragraph (d) and substitute the following paragraph:

"(d) in case such member was appointed by the Dublin Health Authority — by appointment by that Authority."

This amendment was suggested by the hospitals. It has the effect of maintaining the same pattern in (a), (b), (c) and (d). No change of substance is involved.

SECTION 8.
Question proposed: "That Section 8 stand part of the Bill".

This is merely to provide for continuance of membership and the removal of any member who may prove to be unsatisfactory, and other things of that nature.

SECTION 9.

This provides for the first meeting of the council on the appointed day.

It is the Minister who will make the appointed day.

Yes. We cannot precisely state now where or when the meeting will be held.

That is their view.

When is it decided the first meeting will be held?

That is a matter for consultation with the members.

SECTION 10.
Question proposed: "That Section 10 stand part of the Bill."

This is the proviso that the Chairman and Vice-Chairman will hold office for three years.

They will be elected.

I am glad to see provision for a democratic election in a section of this Bill.

It is a voluntary federation, not an enforced one.

The Minister does not habitually appoint the Chairman.

Not in this case. I am not represented on the Council. I am not under any financial obligation to the Council and the Council is not under any obligation to me to do any more than what is provided.

It is not a case of keeping a dog and barking oneself.

SECTION 12.
Question proposed: "That Section 12 stand part of the Bill."

This section provides for management by committees where that is considered desirable.

SECTION 13.
Question proposed: "That Section 13 stand part of the Bill."

This Section empowers the Council to employ the staff necessary for the purpose of its functions.

SECTION 14.

I move amendment No. 6:

In subsection (1), to delete paragraph (k) and substitute the following paragraph:

"(k) the co-ordination of activities in relation to medical education, the conduct of negotiations in regard to such education with the appropriate university, college or other institution (including the making of suitable agreements with such bodies to ensure efficient clinical instruction for medical students) and the provision of facilities for post graduate instruction."

This amendment recasts the wording of the section as originally drafted. It has the effect of clarifying the three points in the paragraph relating to medical education, for which the Council will be responsible. The first is the co-ordination of activities in relation to medical education in the participating hospitals. The second is the conduct of negotiations in regard to such education with appropriate institutions; and the third is the provision of facilities for post-graduate instruction. The amendment is made on the suggestion of the council.

SECTION 15.
Question proposed: "That Section 15 stand part of the Bill."

Under subsection (3)—I think this was raised on the Second Stage—why should the moneys collected be dealt with in this way?

If the intention is to have a real federation there must be a degree of control over the expenditure and use of moneys collected for any particular hospital. All will henceforth be associated with each other. It is intended to ensure that funds will be spent to the best advantage of the federation as a whole.

I take it the federating hospitals agree.

Yes. This Bill is agreed in toto.

SECTION 16.

I move amendment No. 7:

In subsection (2), page 12, line 53, to delete "section 6” and substitute “section 7”.

This is merely for the purposes of correction. It should be Section 7 and not Section 6. The Section deals with membership of the Council and it is a section which must be modified in order to change the representation on the Council where two or more boards amalgamate before the transfer day. Two hospital boards may amalgamate and become one.

SECTION 17.

I move amendment No. 8:

In subsection (2), page 13, line 12, to delete "section 6” and substitute “section 7.”

This section makes provision for the dissolution of a hospital board and the taking over of its functions by the Council

SECTION 18.
Question proposed: "That Section 18 stand part of the Bill".

This section provides that the Council may, with the consent of the Minister, enter into an agreement with the controlling body of a hospital which is not one of the participating hospitals. The federation, for certain purposes, may associate with a hospital which is outside the federation.

Is ministerial consent felt to be necessary there?

SECTION 19.

I move amendment. No. 9:

To add the following subsection:

"(4) In any conveyance, deed, will or other instrument, whether made before, on or after the transfer day, any reference to a participating hospital shall, on or after that day, be construed as a reference to that hospital as amalgamated pursuant to this Act with the other participating hospitals and any reference to the governing body of any participating hospital shall, on and after that day, be construed as a reference to the Council."

This amendment is included at the request of the hospitals. It is on the lines of a similar section of the St. Luke's General Hospital Bill, 1947. Its purpose is to ensure that a legacy will go to a participating hospital, as amalgamated, where that legacy was assigned to a particular hospital when that hospital had a separate existence, but does not become effective until after the transfer day because the death of the testator does not take place until after that date.

SECTION 20.
Question proposed: "That Section 20 stand part of the Bill."

The purpose of this Section is to provide that prior to the transfer date the Council's expenses will be met by the participating hospitals and the basis for dividing these expenses between such hospitals will be the number of beds available for patients at the beginning of the relevant year or on the establishment day as appropriate to the various hospitals.

I take it any grants-in-aid from trust funds will now go to the council and be dealt with by the new body?

Claims for grants will be channelled through the council, but payments will be made to the individual hospitals until the transfer day.

SECTION 22.

I move amendment No. 10:

In subsection (2), to add at the end of the subsection ",but an order under this subsection which alters the functions of a hospital board shall be made only with the consent of that board."

This amendment is included at the request of the hospitals. Its purpose is to ensure that any modification of the Acts or instruments of the foundation which the Minister may make on the request of the Council and which alter the functions of a particular hospital board shall not be made without the consent of the hospital board concerned.

This is to enable the Acts and instruments specified in the Third Schedule to be construed in a modified form.

SECTION 23.

Why the exclusion of the Meath Hospital? Is that because of the Meath Hospital Act?

Yes. The Meath Hospital has been dealt with by a separate Act.

This provides for the laying of orders before the Houses of the Oireachtas.

NEW SECTION.

I move amendment No. 11:—

Before section 25 to insert the following section:

"25. The agreement made on the 15th day of May, 1961, a copy whereof is set out in the Fourth Schedule to this Act, is hereby confirmed and for that purpose it is hereby declared and enacted as follows:

(a) the said agreement shall have statutory effect and shall be binding on the several parties thereto as fully as if it had been enacted in this Act;

(b) each party to the said agreement shall, notwithstanding any limitations on the power of such party to enter into the said agreement, have and be deemed always to have had power to enter into the said agreement;

(c) it shall be the duty of each party to the said agreement and such party is hereby empowered to carry out the said agreement so far as the provisions thereof are to be performed by such party."

On the Second Stage I mentioned that I would introduce an amendment on Committee Stage dealing with the agreement which was then in course of preparation between Trinity College, Dublin, the Royal College of Physicians and Sir Patrick Dun's Hospital relating to the disposal of the estate of Sir Patrick Dun. Amendment No. 11 provides that this agreement which is to be included in the Bill as a Fourth Schedule under a later amendment will have statutory effect.

SECTION 25.
Question proposed: "That Section 25 stand part of the Bill."

This provision has been requested by the representatives of the Royal City of Dublin Hospital. It is necessary to clarify the position as to the personal liability of members of the Board of that Hospital under a deed of co-partnership which was entered into in 1875. It is merely to extinguish their personal liability once they enter the federation.

FIRST SCHEDULE.
Question proposed: "That the First Schedule be the First Schedule to the Bill."

This Schedule lists the participating hospitals.

SECOND SCHEDULE.

I move amendment No. 12:

To delete subparagraph (2) of paragraph 6 and substitute the following subparagraph:

"(2) (a) Where a person is aggrieved by the failure or refusal of the Council to pay compensation under subparagraph (1) of this paragraph, he may appeal to the designated person against the failure or refusal.

(b) Where a person is aggrieved by the amount of any compensation (whether annuity or gratuity) paid by the Council under subparagraph (1) of this paragraph, or by the amount of any part of any such compensation, he may appeal to the designated person against the amount.

(c) An appeal under this subparagraph shall, in the case of an appeal against the failure of the Council to pay compensation, be brought within six months after the termination of the appellant's services and shall, in any other case, be brought within six months after the giving of the decision appealed from.

(d) The designated person shall, in deciding an appeal under this subparagraph, have regard to the annual allowance or gratuity which, in circumstances analogous to those of the appellant, might be granted to an officer or servant (as may be appropriate) under the law relating to the superannuation of officers and servants of local authorities.

(e) The decision of the designated person on an appeal under this section shall be final and, where the appeal is allowed (whether wholly or partly), the Council shall pay compensation or increased compensation accordingly.

(f) In this subparagraph ‘the designated person' means the person designated by the Minister for the purposes of hearing and deciding appeals under this subparagraph."

The general effect of this amendment is to delete the provision providing that the determination by the Council on a question of compensation for loss of office or employment shall be final and conclusive. This is the amendment designed to meet the point raised by Deputy Dillon. To put it briefly, if any person feels aggrieved, a person designated by the Minister will hear his appeal. It resembles a section in the Local Government Superannuation code.

It is very proper.

This is merely a recital of the Acts and instruments under which the hospitals concerned have been founded and constituted.

(1) The King's Professor of Practice of Medicine

(2) The King's Professor of Materia Medica and Pharmacy

(3) The King's Professor of the Institute of Medicine

(4) The King's Professor of Midwifery

AND WHEREAS the duty of the said King's Professors includes the reading and giving of Clinical Lectures upon the Patients in Sir Patrick Dun's Hospital at the times and subject to the conditions prescribed by the Statutes aforesaid AND WHEREAS the above-mentioned Statute 30 Vic. cap. 9 provided for the delivery by the Professor of Surgery in Trinity College, Dublin, and the University Anatomist of the Clinical Lectures required by the School of Physic Act to be delivered by the University Professors of Chemistry and of Botany and empowered the College of Physicians and the Provost (or in his absence the Vice-Provost) and Senior Fellows of Trinity College, Dublin, respectively to appoint a Physician or Surgeon to attend Sir Patrick Dun's Hospital and deliver Clinical Lectures in the place of any of the King's Professors or University Professors or the University Anatomist neglecting to attend the said Hospital or to deliver Clinical Lectures AND WHEREAS a Bill has been introduced before the Oireachtas providing for the Federation and ultimate Amalgamation of Sir Patrick Dun's Hospital with certain other Hospitals AND WHEREAS the parties hereto having regard to such proposed Federation have mutually agreed that it would be expedient to sever the relations hitherto existing between the College of Physicians and Trinity College Dublin and Sir Patrick Dun's Hospital and that on such severance the provisions of these presents shall take effect AND WHEREAS these presents cannot take effect without the sanction of the Oireachtas and it is intended that these presents shall be provisional and conditional only pending the passing and enactment of the said Bill as an Act NOW THIS INDENTURE WITNESSETH AND IT IS HEREBY AGREED AND DECLARED AS FOLLOWS:—

1. In these presents the expression "the operative date" means the date upon which these presents shall be given Statutory effect.

2. Immediately after the operative date the College of Physicians shall proceed to sell and convert into money the trust funds and property representing Sir Patrick Dun's Estate and shall out of the moneys arising from such sale and conversion pay the Costs incurred in respect thereof and shall pay and apply the residue of the said proceeds of sale (hereinafter referred to as "the net proceeds of sale") in manner hereinafter provided.

3. (a) There shall be set apart and retained by the College of Physicians a capital sum equal to 232/500ths of the net proceeds of sale.

(b) After such sum shall have been so set aside and retained by the College of Physicians the remaining 268/500ths of the net proceeds of sale shall be paid and transferred by the College of Physicians to the Governors of Sir Patrick Dun's Hospital to be held by them UPON TRUST to apply the same whether capital or income in their discretion for or towards the cost of Medical Surgical or Nursing education or instruction in connection with the said Hospital or of research in the arts of Medicine or Surgery and of Sciences connected therewith or of any specialised appliances or equipment for use in the said Hospital.

(c) Out of the said sum so retained by the College of Physicians a capital sum equal to 43/500ths of the net proceeds of sale shall be paid by the College of Physicians to Trinity College Dublin on the date upon which the first King's Professor holding office on the operative date vacates office and a like sum equal to 43/500ths of the net proceeds of sale shall be paid by the College of Physicians to Trinity College Dublin on the date upon which the second King's Professor holding office on the operative date vacates office.

(d) The balance of the capital sum retained by the College of Physicians remaining after payment thereout of the said sums to Trinity College Dublin shall remain the property of the College of Physicians.

4. The right and obligation of the College of Physicians to appoint King's Professors shall cease as from the operative date as from which date the right to appoint all future King's Professors shall be vested solely in Trinity College, Dublin.

5. Each of the King's Professors holding office on the operative date shall retain his office for the period for which he has been elected or until (under any of the terms and conditions under which he holds the same) such appointment shall in the meantime cease or determine.

6. The salaries of each of the King's Professors holding office on the operative date shall be paid by the College of Physicians during the remainder of their period of office and the salaries of all the King's Professors to be hereafter appointed or elected by Trinity College, Dublin, under the provisions of Clause 4 hereof shall be fixed from time to time and paid by Trinity College Dublin who hereby undertake to apply to the payment of such salaries all income which may be received by them from time to time from the said Capital sums to be handed over to them as aforesaid pursuant to the provisions of Clause 3 (c) hereof.

7. As from the operative date the King's Professors, University Professors and University Anatomist shall not by virtue of their office as such be required or entitled either in person or by substitute to attend or deliver clinical lectures at Sir Patrick Dun's Hospital provided always that this clause shall not in any way affect or interfere with the right of any individual person who shall on the operative date be a member of the Hospital Staff by virtue of his being a King's Professor, University Professor, University Anatomist or a Physician or Surgeon duly appointed in the place of a King's Professor, University Professor or University Anatomist to continue to hold office as a member of the Hospital staff upon the terms and conditions existing on the operative date.

8. As from the operative date the right of the College of Physicians to appoint Physicians and the right of the Provost or Vice-Provost and Senior Fellows of Trinity College Dublin to appoint Surgeons to attend and deliver Clinical Lectures at Sir Patrick Dun's Hospital shall cease and determine.

9. As from the operative date the Visitors of the College of Physicians, the President, Vice-President and Censors of the same, and the Provost of Trinity College Dublin shall cease to be Governors of Sir Patrick Dun's Hospital ex officio.

10. During such period as shall intervene between the operative date and the date referred to in the said Bill as "the Establishment Day" the Board of Governors of Sir Patrick Dun's Hospital shall have power and the exclusive right to appoint Physicians and Surgeons for the purpose of filling up any vacancies occurring in the Hospital Staff.

11. From and after the operative date and until the date in the said Bill referred to as "the Establishment Day" all the powers to appoint Governors of Sir Patrick Dun's Hospital vested on the operative date in the Visitors, President, Vice-President and Censors of the College of Physicians and the Provost of Trinity College Dublin shall be vested in and exercisable by the Board of Governors of Sir Patrick Dun's Hospital.

IN WITNESS whereof the Provost, Fellows and Scholars of the College of the Holy and Undivided Trinity of Queen Elizabeth near Dublin have caused their corporate Seal to be hereunto affixed and the President and Fellows of the Royal College of Physicians have caused their Seal to be hereunto affixed and the Governors of Sir Patrick Dun's Hospital have hereunto set their hands and affixed their Seals the day and year first herein written.
