asked the Minister for Local Government if he is aware that the Labour Court was informed by a local authority (Labour Court Reference D.456 (3)) that at least ten county councils were not allowing section 45 of the Local Government (Superannuation) Act, 1956, to operate; and if in view of the Employment and Emergency Scheme Vote he will indicate what steps will be taken to prevent county managers from dismissing workmen who exercised an option under section 44 of the Act.

I am not aware that the position is as stated by the Deputy. In the document referred to the local authority are quoted as saying that "at least ten other county councils make it a condition prior to the return of superannuation contributions to servants proposing to leave their employment, that the servants will not be reemployed." I have no function in this matter.
