Vol. 191 No. 5

Ceisteanna—Questions. Oral Answers. - Quashing of Exemption Orders.

20.

asked the Minister for Justice the number of general exemption orders, special exemption orders and area exemption orders which were brought before the High Court since the coming into operation of the Intoxicating Liquor Act, 1960, on 4th July 1960, for the purpose of having them quashed; the number quashed; who bore the costs and expenses of having them quashed; and the amount of the costs and expenses so incurred.

Twenty-eight General Exemption Orders and two Special Exemption Orders have been brought before the High Court since the coming into operation of the Intoxicating Liquor Act, 1960, for the purpose of having them quashed and all have been quashed. One case, is, however, on appeal to the Supreme Court.

In no case was an order as to costs made by the High Court.

Fees and expenses incurred by the State amounted to £513 5s. 0d.

Would the Parliamentary Secretary now say that, in view of the information he has given us, the Intoxicating Liquor Act would need amendment in that respect?

That is an entirely separate question.
